I’ve now seen three different legal analysts say that they think the narrow holding in Perry makes it unlikely that the Supreme Court will even hear the case, since it only implicates California and not other states.
Since the decision relies so heavily on Romer in just applying already settled law, I think it’s probably unlikely to be granted a reahearing en banc.

I mean, either way, there will probably be a rehearing en banc, where a larger number of 9th Circuit judges hear the case, and then a definite appeal to the Supreme Court, but this is still a bfd.
Edit: a rehearing “en banc” is, as I said before, when more judges from the 9th circuit would hear the case. Usually only 3 judges hear any given case on appeal. In big cases that are...
